1. Introduction and general provisions
1.1. This Health and Fitness Safety Disclaimer (the “Disclaimer”) establishes the conditions, warnings, limitations and safety-related information applicable to the use of the mobile application operating under the name Coach.ai (the “Application”), together with its associated software, artificial intelligence functionalities, exercise monitoring capabilities, instructional materials, digital content, updates and related services (collectively, the “Services”). The Application is developed, maintained and operated by Stay Fit Software - FZCO, a legal entity duly incorporated under the laws of United Arab Emirates (the “Company”, “we”, “us” or “our”).
For the purposes of this Disclaimer, “User”, “you” and “your” refer to any natural person who downloads, installs, registers for, accesses or otherwise uses the Application.
1.2. The Application is a digital fitness assistance solution designed to support Users in performing physical exercises, understanding selected aspects of movement execution and monitoring personal training activities. The Application incorporates artificial intelligence, computer vision, pose estimation and automated movement analysis technologies to generate exercise-related observations, repetition counts, technique-related feedback and training guidance. The Services are intended for general fitness, physical activity, exercise education and wellness purposes.
1.3. This Disclaimer is intended to inform Users of the physical risks associated with exercise, explain the limitations of automated coaching technologies, identify circumstances in which professional medical advice may be appropriate and establish reasonable expectations concerning the safe use of the Application. The Company recognises that physical exercise involves risks that cannot be eliminated through digital monitoring or automated feedback. The purpose of this Disclaimer is not to transfer to Users any responsibility that the Company is legally required to assume, but to communicate material safety information and support informed use of the Services.
1.4. This Disclaimer supplements the Company's Terms and Conditions of Use, Privacy Policy and Camera and Live Video Processing Notice. Where provisions of this Disclaimer concern the collection or processing of personal information, the Company's Privacy Policy shall provide the applicable data protection disclosures. Nothing in this Disclaimer shall exclude, restrict or diminish rights or protections established by mandatory consumer protection, product safety, product liability or other applicable legislation.
2. Fitness and wellness purposes
2.1. The Application provides automated assistance intended to support general physical training, exercise execution, fitness education and personal wellness. Its functionality may include recognition of supported exercises, repetition counting, evaluation of certain movement characteristics and provision of automated coaching observations. The Services are intended to supplement the User's physical activity rather than replace individual judgment, appropriate safety precautions or professional assistance where necessary.
2.2. The Application is not intended for the diagnosis, prevention, monitoring, prediction, prognosis, treatment or alleviation of diseases, injuries or medical conditions. The Application is not intended to provide medical rehabilitation, therapeutic exercise prescriptions, clinical assessments or other regulated healthcare services. The Company does not represent that the Application constitutes a medical device under Regulation (EU) 2017/745 unless such classification is expressly established and communicated in accordance with applicable law.
2.3. Information, recommendations, assessments and instructions generated or displayed through the Application are provided for general fitness purposes only. They do not constitute medical advice, medical diagnosis, prescribed treatment, physiotherapy or professional healthcare supervision. The Application does not evaluate whether an individual is medically fit to perform a particular exercise.
2.4. Use of the Application does not establish a doctor-patient, physiotherapist-patient or other regulated healthcare professional relationship between the User and the Company. The use of terminology such as “fitness coach”, “personal trainer”, “exercise assistant” or similar expressions refers to the Application's automated functionality and shall not be interpreted as a representation that a qualified human professional is personally supervising the User.
2.5. Users should consult an appropriately qualified healthcare professional before commencing or materially changing an exercise programme where they have concerns regarding their physical health, medical suitability or ability to exercise safely. Professional consultation is particularly important where a User has a known cardiovascular, respiratory, neurological, musculoskeletal or other condition that may affect exercise tolerance, or has previously been advised to restrict physical activity. Nothing in the Application should be interpreted as authorising a User to disregard professional medical advice or undertake activities contrary to an existing medical restriction.
3. Inherent risks of physical exercise
3.1. Physical exercise inherently involves physical exertion and may expose individuals to risks of discomfort, injury or other adverse health consequences. Such risks may arise even where an exercise appears relatively simple, is performed without specialised equipment or is undertaken in accordance with general fitness instructions.
3.2. Depending on the type of exercise and the circumstances in which it is performed, potential adverse consequences may include muscle strain, ligament injury, tendon injury, joint damage, falls, loss of balance, excessive fatigue, overexertion and other forms of physical harm. More serious complications may occur in certain circumstances, particularly where intense physical activity is undertaken by individuals with relevant underlying health conditions or without appropriate preparation.
3.3. The risks associated with exercise vary according to numerous factors, including age, physical condition, training experience, strength, mobility, coordination, fatigue, environmental conditions, exercise technique and the intensity of the activity performed. The Application cannot independently evaluate every factor relevant to an individual User's safety.
3.4. Automated movement analysis and feedback may support an individual's understanding of exercise execution but cannot eliminate the inherent risks of physical activity. The availability of the Application shall not be interpreted as a guarantee that a particular exercise or workout session is safe for a particular User.
3.5. Users should undertake physical exercise only where they reasonably consider themselves capable of performing the relevant activity safely. Where uncertainty exists concerning physical suitability or the appropriate intensity of exercise, Users should obtain professional guidance before proceeding.
4. Artificial intelligence and automated coaching limitations
4.1. The Application uses artificial intelligence and computer vision technologies to generate exercise-related feedback based on observable movement characteristics. The analysis is performed automatically and does not involve continuous supervision by a qualified human fitness professional.
4.2. The Application may be unable to identify certain movements accurately or may provide incomplete or incorrect assessments. Such limitations may arise due to camera positioning, device performance, lighting conditions, clothing, exercise complexity, movement speed, visual obstructions or limitations inherent in the underlying analytical models.
4.3. Automated coaching instructions may occasionally contain inaccuracies, fail to account for the User's individual circumstances or recommend adjustments that are not suitable for a particular User. Users should not assume that automated instructions are appropriate in every situation. Where guidance appears unsafe, unclear or inconsistent with the User's physical capabilities, the User should discontinue the relevant exercise or seek additional guidance.
4.4. The Application may fail to identify incorrect posture, excessive movement range, loss of stability, unsafe loading or other potentially hazardous exercise conditions. The absence of an automated warning or corrective instruction does not establish that an exercise is being performed safely or correctly.
4.5. The Company does not represent that automated coaching can predict, identify or prevent every circumstance that may result in physical injury. The Application is not designed to provide a comprehensive safety monitoring system or replace appropriate supervision in circumstances where such supervision is reasonably necessary.
4.6. Automated movement analysis may not fully account for anatomical differences, mobility limitations, previous injuries, disabilities or other personal physical characteristics. A movement pattern identified as preferable by the Application may not be suitable for every individual. Users should avoid making exercise adjustments that cause pain, discomfort, instability or excessive physical strain.
4.7. Users should exercise reasonable independent judgment when interpreting automated feedback and should prioritise their physical safety over attempting to achieve a particular automated assessment, movement score or performance result. No User should continue an exercise solely because the Application has not generated a warning.
5. Health status and physical suitability
5.1. Users are responsible for considering their known health circumstances and physical limitations when deciding whether to undertake a particular exercise. This responsibility does not relieve the Company of its applicable obligations concerning product safety, software conformity or the accuracy of representations made about the Services.
5.2. Users with existing medical conditions that may affect exercise safety should obtain appropriate professional advice before undertaking potentially unsuitable or strenuous physical activity. This is particularly relevant where a medical professional has recommended limitations on exercise intensity, duration, movement range or resistance training.
5.3. Users recovering from an injury or experiencing persistent pain, instability or limited mobility should not rely on the Application as a substitute for professional rehabilitation guidance. Exercises that may be suitable for general fitness purposes may be inappropriate during recovery from injury.
5.4. Users who are pregnant, have recently given birth or are undergoing postpartum recovery should seek appropriately qualified medical or fitness guidance before undertaking exercises that may require modification. The Application does not independently assess pregnancy-related or postpartum exercise suitability.
5.5. Certain medications, medical treatments and personal health circumstances may affect balance, coordination, heart rate, exercise tolerance or the body's response to physical exertion. Users should take such circumstances into account and consult an appropriate healthcare professional where necessary.
5.6. Users should reassess the suitability of their training activities if they experience a significant change in physical condition, develop new symptoms, sustain an injury or receive professional advice to modify or restrict physical activity.
6. Safe exercise practices
6.1. Users should select exercises that are appropriate for their physical abilities, training experience and current condition. Users should avoid exercises requiring levels of strength, balance, coordination or mobility beyond their reasonable capabilities.
6.2. Training intensity, resistance, duration and frequency should be increased progressively and with appropriate regard to individual fitness levels. Excessive or sudden increases in training load may increase the risk of physical injury or overexertion.
6.3. Users are encouraged to undertake appropriate preparation and recovery activities consistent with the nature and intensity of their exercise sessions. The suitability of particular warm-up, recovery or mobility activities may vary according to the User's circumstances.
6.4. Users should perform exercises in a controlled manner and avoid movements that cause pain, excessive strain or instability. Automated feedback may assist with exercise technique but should not be treated as a definitive assessment of biomechanical safety.
6.5. Users should not attempt to force movements beyond their comfortable or medically appropriate range of motion. Where the Application suggests a movement adjustment that causes discomfort or appears unsuitable, the User should discontinue or disregard the relevant instruction.
6.6. Users should take reasonable steps to avoid excessive fatigue and should allow appropriate recovery between demanding activities. Training through severe discomfort, unusual weakness or other warning signs may increase the risk of injury.
6.7. Users should consider their hydration, the surrounding temperature, ventilation and other environmental conditions relevant to exercise safety. Appropriate precautions should be taken where physical activity occurs in excessively hot, cold, humid or otherwise unsuitable conditions.
7. Training environment and equipment safety
7.1. Users should ensure that the area in which they exercise is reasonably suitable for the movements being performed. The training area should provide sufficient space and should be free from avoidable obstacles, unstable surfaces and other foreseeable hazards.
7.2. Where camera-assisted functionality is used, the device should be positioned securely and in a manner that does not create an additional risk of falling equipment, obstruction or physical interference. Users should not compromise their exercise technique or adopt unsafe body positions solely to remain visible within the camera's field of view.
7.3. Users should use exercise equipment in accordance with the manufacturer's instructions and applicable safety recommendations. The Application does not independently inspect or verify the mechanical condition, installation or suitability of equipment used during a workout.
7.4. Exercises involving free weights, resistance equipment or other external loads may require additional precautions. Users should select appropriate loads and avoid attempting lifts or movements beyond their training capabilities. Where appropriate, Users should seek supervision or assistance from a qualified individual.
7.5. Exercises involving elevated surfaces, unstable positioning, complex balance requirements or technically demanding movements may carry additional risks. The Application should not be relied upon as the sole source of safety supervision for such activities.
7.6. Users should avoid becoming distracted by the device interface during movements requiring concentration, balance or controlled execution. Where necessary, Users should pause the exercise before reviewing detailed instructions or interacting with the device.
8. Emergency situations and warning signs
8.1. Users should immediately discontinue exercise where they experience symptoms suggesting that continued physical activity may be unsafe. Such symptoms may include chest pain, dizziness, faintness, sudden weakness, severe or unusual shortness of breath, loss of balance, acute pain or other significant physical distress.
8.2. Where symptoms are severe, persistent or suggest a medical emergency, Users should seek appropriate medical assistance without delay. In the European Union, emergency assistance may be requested through the emergency telephone number 112.
8.3. The Application is not designed to detect medical emergencies, monitor vital signs for clinical purposes or automatically summon emergency assistance.
8.4. Users must not wait for the Application to identify a medical emergency before discontinuing exercise or obtaining assistance. The absence of a warning does not establish that the User's condition is safe.
8.5. The Application does not replace emergency medical services, clinical monitoring systems or appropriate professional healthcare assistance.
9. Exercise results and performance expectations
9.1. The Company does not guarantee that use of the Application will produce a particular improvement in strength, endurance, mobility, physical appearance, body composition, weight management or general fitness.
9.2. Fitness outcomes depend on individual circumstances, including training consistency, exercise selection, physical condition, recovery, nutrition, genetics and other factors outside the Company's reasonable control.
9.3. Exercise-related measurements generated by the Application, including repetition counts, movement assessments and other performance indicators, may be subject to technical inaccuracies.
9.4. The Company does not represent that exercise metrics generated through the Application are suitable for clinical diagnosis, medical monitoring or other regulated healthcare purposes.
9.5. Where Users save workout history, the corresponding information is intended to support general training progress monitoring. Such historical records should not be treated as comprehensive or medically validated assessments of physical health.
10. Camera-assisted training and safety
10.1. The Application performs camera-based movement analysis entirely on the User's device. Video footage is not transmitted to Company servers or external artificial intelligence infrastructure.
10.2. The Application does not permanently record or retain workout video footage. The Company does not maintain historical recordings that could be reviewed by human professionals following completion of an exercise session.
10.3. The use of camera-assisted analysis does not mean that a human professional is observing the User's movements or supervising the training session.
10.4. Camera-based assessment may not accurately identify all relevant aspects of exercise execution, particularly where important movements, loads or body positions are not visible to the camera.
10.5. Users should regard camera-assisted feedback as supplementary fitness assistance rather than a comprehensive safety assessment. Users should not attempt to satisfy an automated movement assessment at the expense of their comfort, stability or physical safety.
10.6. Additional details concerning camera access, local visual processing and the absence of video retention are provided in the Company's Camera and Live Video Processing Notice and Privacy Policy.
11. User responsibilities
11.1. Users are expected to use the Application responsibly and take reasonable precautions when undertaking physical exercise.
11.2. Users should review and observe relevant safety information provided through the Application, this Disclaimer and any accompanying exercise instructions.
11.3. Users should take account of their physical capabilities and should not follow instructions that they reasonably believe to be unsafe or unsuitable.
11.4. Where an exercise involves significant technical complexity, substantial resistance or elevated physical risk, Users should consider obtaining assistance from an appropriately qualified fitness professional.
11.5. Users should ensure that their exercise activities do not unnecessarily expose other individuals to foreseeable physical risks.
11.6. The User's acceptance of this Disclaimer does not constitute an agreement to assume risks arising from the Company's negligence, defective products, breach of statutory duty or other circumstances for which liability cannot lawfully be excluded.
12. Limitations of liability
12.1. The Company's liability arising from the development, provision or operation of the Application shall be determined in accordance with applicable law and the Terms and Conditions. This Disclaimer is intended to communicate relevant exercise risks and technological limitations and shall not operate as a general exclusion of legal responsibility.
12.2. To the extent permitted by applicable law, the Company shall not be responsible for adverse consequences arising exclusively from circumstances for which it is not legally responsible, including improper use of exercise equipment, disregard of clear safety instructions or undertaking exercises contrary to known medical restrictions.
12.3. The Company does not guarantee that automated movement analysis will identify every hazardous condition or prevent all physical injuries. However, the automated nature of the Services does not exempt the Company from applicable duties concerning safety, conformity, reasonable care and the accuracy of its representations.
12.4. Nothing in this Disclaimer excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, wilful misconduct, liability arising under mandatory product liability legislation or any other liability that cannot lawfully be excluded.
12.5. Any limitation or exclusion shall be interpreted consistently with mandatory consumer protection legislation and shall not create an unfair imbalance contrary to applicable law.
12.6. Users retain any remedies available under applicable consumer protection, product liability, digital services and other mandatory legislation.
13. European Union legal framework
13.1. The Application shall remain subject to applicable European Union and national consumer protection requirements. The Company shall not rely on this Disclaimer to exclude mandatory obligations concerning the conformity or safety of the Services.
13.2. Where applicable, the Application may constitute digital content or a digital service under Directive (EU) 2019/770 and relevant national implementing legislation. Mandatory requirements concerning functionality, conformity, security and necessary updates shall remain unaffected.
13.3. The Company recognises that software and automated fitness functionality may be subject to applicable product safety and product liability requirements. Nothing in this Disclaimer shall limit liability arising under mandatory product liability legislation.
13.4. The Application is intended for general fitness and wellness purposes rather than a specific medical purpose. The Company's description of the Application shall not substitute for an assessment of its intended purpose and regulatory classification under Regulation (EU) 2017/745 where such an assessment is required.
13.5. The Company shall assess and comply with artificial intelligence requirements applicable to the actual functionality, intended purpose and regulatory classification of the Application. The automated nature of the Services shall be communicated to Users in accordance with applicable transparency obligations.
